    Initial Draft of a Healthcare Reform Bill Released.... 06/09/2009

    An initial draft of a comprehensive healthcare reform bill prepared by Senator Edward Kennedy (D-MA) and the staff of the Senate Health, Education, Labor and Pensions Committee, dubbed the "American Health Choices Act," has been circulated. This legislation is the first of two comprehensive health reform bills expected from Senate leaders. Also to be introduced soon is a major health reform bill in the House of Representatives, a result of extensive negotiations by three House committees with jurisdiction on healthcare: Ways and Means, Energy and Commerce, and Education and Labor.

    The Healthcare Reform Educational Task Force will provide forthcoming analysis on this and subsequent draft legislation.

    On February 17, 2009, President Obama signed into law the Health Information Technology and
    Clinical Health Act (HITECH) as part of the American Recovery and Reinvestment Act. HITECH
    codifies and funds the Office of the National Coordinator for Health Information Technology
    (ONC) and provides for the infusion of $19 billion over a four-year period, in grants and loans, for
    infrastructure and incentive payments under Medicare and Medicaid for providers who adopt and use
    health information technology (HIT). It also expands security and privacy provisions and penalties to
    HIPAA business associates of covered entities. The implications of HITECH for hospitals, health
    care providers, vendors, health information exchanges (HIEs), and Regional Health Information
    Organizations (RHIOs) are far-reaching.

    Class action in data breach case largely eviscerated.... 05/26/2009

    The United States District Court for the District of Maine significantly restricted the ability of plaintiffs to pursue by class action, claims arising from a data breach. On May 12, 2009, the U.S. District Court for the District of Maine dismissed the majority of class action claims brought against Hannaford Brothers, Co., a Maine-based grocery store chain, for breaches of consumers’ credit-card data at various locations of Hannaford stores throughout New England and Florida.  In dismissing the majority of the claims, the court allowed a limited number of negligence-based claims to move forward, provided that the plaintiffs could demonstrate actual damages.

    According to a press release on http://www.nyhealth.gov, "The Departments of Health and Insurance contracted with the Urban Institute to determine the cost and coverage implications of four health reform proposals: (1) the Public-Private Partnership proposal that simplifies and expands existing public programs and reforms private health insurance; (2) New York Health Plus, Assemblyman Richard N. Gottfried's proposal that gives all New Yorkers an option to enroll in Family Health Plus; (3) Public Health Insurance for All, a single payer public health insurance option; and (4) the Freedom Plan, an option that relies on regulatory flexibility and tax credits. The Public-Private Partnership proposal is similar to the proposal now being debated in Congress."

    President Obama Discusses New Report from U.S. Treasury Department regarding Health Insurance.... 09/14/2009

    In his weekly address, President Obama discussed the Treasury Department's report on the instability of American's health insurance coverage.   The report concluded that approximately half of all Americans under 65 will lose their health coverage for some period of time in the next 10 years.  The report also found that about 1/3 of Americans will go without coverage for more than one year.  The President's remarks are available at:
